Anthony J. Harwood

Tony Harwood is a trial lawyer with over 25 years of experience in business litigation, arbitration and white-collar criminal investigations. His practice encompasses matters involving real estate, technology and intellectual property, securities, professional liability and legal ethics. He has represented clients in trials and appeals in state and federal courts and in arbitral forums, including victories in the highest appellate courts of the States of New York and Illinois. His clients include large multinational corporations, multi-billion dollar investment funds, law firm partnerships, technology companies, small businesses and individuals.

Mr. Harwood has an AV Preeminent rating from Martindale Hubbell, which is the highest rating the organization gives. It demonstrates that Mr. Harwood’s peers rank him at the highest level of professional excellence. He is a member of the Executive Committee of the Commercial and Federal litigation Section of the New York State Bar Association, where he is Co-Chair of the Committee on Ethics and Professionalism. Representative matters include:

Technology and Intellectual Property

  • Obtained a judgment after a three-week jury trial, dismissing all antitrust claims against a multinational technology corporation. Successfully defended the judgment on appeal to the Fifth Circuit Court of Appeals.
  • Obtained a pretrial dismissal, and obtained an affirmance in the Supreme Court of the State of Illinois, representing a leading manufacturer of cellular telephones in a class action, product liability litigation.
  • Obtained injunctions on behalf of nationally and internationally recognized technology companies, involving disputes over rights to famous trademarks and Internet domain names.

Professional Liability and Legal Ethics

  • Defended a leading international law firm against claims by a former member of the executive committee for retirement benefits. Obtained a dismissal of all claims in the trial court and an affirmance from New York’s highest Court of Appeals.
  • Defended an international law firm in multi-district, class action litigation alleging claims of securities fraud and malpractice arising out of the firm’s representation of the lead underwriter in a public offering. Obtained a dismissal of all claims on a pretrial motion.
  • Defended a leading New York law firm in a three-week trial against claims of malpractice arising out of a stock purchase agreement. Obtained a judgment dismissing all claims and an affirmance on appeal.

Securities Litigation

  • Prosecuted to verdict a class action in a six-week jury trial seeking a multi-billion dollar recovery on securities fraud claims. Cross-examined the defendant corporation’s President and Chief Operating Officer, the Senior Vice President for Corporate Finance and the President of the defendant’s largest division. Conducted the direct examination of the plaintiff’s expert witness on damages and cross examined the defendants’ expert on damages.
  • Prosecuted securities fraud claims on behalf of high net worth investors in a limited partnership engaged in oil and gas exploration. Recovered the investors’ entire investment in a settlement after defeating defendants' motion for summary judgment.
  • Defended a leading investment bank in multi-district litigation alleging claims of securities fraud arising out of a private offering of securitized assets. Obtained dismissal of all claims on a pre-trial motion.

Real Estate

  • Prevailed in injunction proceedings for a real estate investor in actions involving auctions by the City of New York.
  • Prosecuted a claim of malpractice against an architecture firm in connection with a high-end residential construction project.
  • Represented landlords and tenants in disputes over rent payments for leases for commercial property.
  • Investigations and Enforcement Proceedings
    Represented a senior bank executive in a criminal investigation by the Manhattan District Attorney concerning allegations of fraud related to the bank’s transactions with Enron.
  • Represented a public distribution company in a formal investigation before the Securities and Exchange Commission concerning allegations of improper revenue recognition.
  • Represented a foreign business executive in an investigation by the Department of Justice of the executive’s dealings with a vendor in the oil and gas industry.
  • Represented executives of an investment company in an investigation by the Manhattan District Attorney into charges of campaign finance violations.
